ILLINOIS — Amid rising anti-Trump protests and political unrest sweeping the nation, Illinois Attorney General Kwame Raoul has issued formal guidance to help residents understand their rights and responsibilities when participating in public demonstrations.
With protests erupting in Chicago, Los Angeles, and other cities in response to recent federal policy flashpoints, Raoul is encouraging residents to stay peaceful and law-abiding while making their voices heard.
Attorney General Raoul’s ‘Know Your Rights’ Advisory
The advisory, titled “Safely Participating in Peaceful Protests in Illinois,” was published on the official website of the Illinois Attorney General’s office. It aims to clarify constitutional rights under the First Amendment, while outlining behaviors that cross legal boundaries.
“It is impossible to ignore the widespread injustice taking place around the nation at the direction of the Trump administration,” Raoul said. “However, protesters have a responsibility to follow the law and express their views peacefully.”
Raoul emphasized that physical violence, property destruction, and criminal trespass are not protected under the First Amendment. His message is both a caution to demonstrators and a reminder to law enforcement that peaceful assembly is a protected civil liberty.
Reinforcing the Illinois TRUST Act
Raoul’s announcement also reinforces the importance of the Illinois TRUST Act, which bars state and local police from serving as de facto agents of federal immigration enforcement. His office clarified that:
-
Local officers must not act on behalf of federal agencies like ICE.
-
Discrimination based on immigration status is prohibited.
-
Law enforcement should aim to maintain public safety without racial profiling or overreach.
Protesters Warned Against Obstructing Federal Officials
Raoul also warned participants that interfering with a federal employee, particularly during immigration enforcement actions, may be considered a federal offense.
“I encourage people to review the ‘Know Your Rights Advisory’ on my office’s website before participating in a demonstration,” Raoul stated.
This warning comes as tensions rise across various cities where demonstrators have confronted federal officials. His guidance aims to strike a balance between civic expression and compliance with the law.
Guidance for Law Enforcement and the Public
The Attorney General’s advisory is intended not just for protesters, but also as a reference guide for police agencies across the state. It emphasizes the need for measured, fair enforcement practices and de-escalation strategies.
“Safeguarding peace must not come at the cost of basic rights,” said Raoul, urging officers to protect free speech while maintaining public order.
To support accountability, Raoul’s office also shared a hotline (1-877-581-3692) and email address (civilrights@ilag.gov) where residents can report any violations of their rights during demonstrations.
Context: A Nation on Edge
The timing of the advisory aligns with a surge in anti-Trump sentiment, particularly over his administration’s immigration enforcement, social policy, and policing tactics. As protest events gain momentum in Illinois, the Attorney General hopes this guidance will prevent avoidable legal conflicts while empowering safe civic participation.
Raoul has historically been outspoken against federal overreach, and this latest statement reinforces Illinois’ commitment to protecting civil rights—even in tense political climates.
