Why Illinois Still Hasn’t Regulated Intoxicating Hemp Products Like Delta-8

ILLINOIS — As other states act to regulate or restrict intoxicating hemp products like Delta-8, Illinois remains stalled. A proposed statewide ban backed by Gov. JB Pritzker was blocked earlier this year, and little action has followed — despite mounting concerns from health advocates and policymakers alike.

The issue mirrors a recent development in Texas, where Gov. Greg Abbott vetoed a similar hemp regulation bill — but promptly called for a special session to adopt strict access controls. Illinois, by contrast, has not committed to any clear timeline or next steps.

Pritzker’s Bill Blocked by Welch and Johnson Allies

In January 2025, Gov. Pritzker attempted to advance a bill that would have effectively banned synthetic THC-infused products such as Delta-8, citing their easy availability in gas stations and the risk they pose to teenagers and vulnerable users.

However, the bill was abruptly halted by Illinois House Speaker Emanuel “Chris” Welch, who declined to call it for a vote — reportedly due to opposition from within his Democratic caucus and allies of Chicago Mayor Brandon Johnson, according to the Chicago Tribune.

That political decision was labeled one of Pritzker’s most embarrassing defeats since he took office in 2019.

Little Progress Since Promised Regulatory Framework

After the legislative collapse, Welch and Johnson pledged to work on a more balanced regulatory framework that would impose packaging standards, production controls, and age restrictions — without completely banning hemp derivatives.

Yet, months later, there’s been no meaningful progress. The spring legislative session ended without action. In Chicago, a City Council subcommittee held one hearing, led by Ald. William Hall (6th), but no policy has followed.

With both state and city leadership largely quiet, some municipalities and even individual Chicago wards have enacted local bans on Delta-8 and similar compounds, resulting in a patchwork of regulations with little enforcement consistency.

Hemp Industry Continues to Lobby and Stall Reform

Industry lobbyists, who represent both unregulated hemp producers and some segments of the legal cannabis market, appear to have successfully delayed action. The hemp sector in particular has resisted legislation that would restrict its products, fearing loss of access to retail shelf space.

The Tribune editorial board argues that this “Wild West” status quo benefits only the hemp lobby — while teens remain exposed, health risks go unaddressed, and regulators lack tools to enforce safety.

If Texas enacts tighter controls during its upcoming special session, the contrast may force Illinois leaders to revisit the issue and avoid falling further behind.
